Many workers who are injured at work are surprised to learn that their accident does not allow them to file a lawsuit against their employer.  As a general rule, when you are injured at work due to the negligence and/or fault of your employer, you cannot sue your employer for money damages.  If a work place safety issue exists at your work that contributed to your accident, you are free to file a claim with Indiana OSHA.  The attachment to this paragraph provides information on reporting a claim to Indiana OSHA.  If your accident happened due to the negligence of a “third party”, you may file a lawsuit against that third party.  Examples of third parties include the manufacturer of a machine, an outside vendor, a delivery person, or any other individual or company other than your employer.     IOSHA Contact info
