7 Day Waiting Period for Temporary Total Disability Pay

Our firm often gets asked about the 7 day waiting period.  I.C.22-3-3-7 says that worker’s compensation weekly benefits (temporary total disability pay) begin on the 8th day of disability.  The first 7 days will be paid if you are disabled for more than 21 days.  Our firm doesn’t know why the law requires a 7 day waiting period and certainly this is not fair.  However, the law does say there is a 7 day waiting period.  This waiting period does not apply to medical benefits.  If you were hurt at work, your employer must provide your medical treatment from the moment you are hurt.
