Benefits provided in the Indiana Worker’s Compensation Act are the only remedy an employee has against his or her employer for work related injuries. An employee cannot sue his or her employer for a work related injury in court. This limitation was part of the trade-off for an employer accepting automatic liability for work injuries. However, an injured employee can sue a third party if another party is liable to some extent for the work accident. A third party is any individual or entity other than the employer and not in the same employment as the injured worker.
