If I am on short-term disability for my work injury since work comp denied my claim, what happens if I win my case?

If you win your worker’s compensation case, then you may only claim the difference, if any, between the short-term or long-term disability pay you received and what you would have been entitled to in TTD benefits.

The worker’s compensation insurance carrier should then reimburse the short-term or long-term disability carrier the amount they paid you.

However, if you paid the short-term or long-term disability premiums, then you may or may not be required to repay these benefits. Check the contract language in your policy as it should address any reimbursement questions.

Again, make sure this issue is addressed before signing the final settlement agreement so that you do not run the risk of having to reimburse the short-term or long-term disability carrier out of your settlement money.
